Valley Milk Products LLC has reached an agreement on the terms of a consent decree of injunction with the United States Food and Drug Administration (FDA), as filed today in the U.S. District Court for the Western District of Virginia. The consent decree relates to previously announced inspectional observations and records review at the company’s Strasburg, Virginia facility and the subsequent seizure of milk powder and buttermilk powder.

The decree recognizes that the company is currently not producing powder at its Strasburg, Virginia plant and provides a process by which Valley Milk must adhere should the company ever want to restart powder production at that facility. The decree also includes steps by which the company can recondition the seized milk and buttermilk powder with appropriate FDA oversight.

Prior to the consent decree, Valley Milk initiated a voluntary recall of milk and buttermilk powders. There have been no reports of consumer illness associated with any Valley Milk products.

The consent decree does not apply to production of fluid dairy ingredients at the Valley Milk facility and that production will continue.

We will continue to work cooperatively with the FDA and the Commonwealth of Virginia to provide products that meet all applicable government food safety standards.”
